구독 약관

인터내셔널 헤럴드 트리뷴 - 중앙데일리 온라인 구독신청은 공정거래위원회에서 심의 한 표준약관을 사용하고 있습니다. The IHT-JoongAng Daily on-line subscription order system(hereafter "mall") observe the provision reviewed by the Fair Trade Commission.

제1조(목적) - Article1.(purpose)

이 약관은 인터내셔널 헤럴드 트리뷴-중앙데일리 온라인 구독신청(이하 "몰"이라 합니다)에서 제공하는 인터넷 관련 서비스(이하 "서비스"라 합니다)를 이용함에 있어 "몰"과 이용자의 권리?의무 및 책임사항을 규정함을 목적으로 합니다. 
This provision is to prescribe the rights and obligations of both mall and customers when operating the Internet service(hereafter “service”) provided by the IHT-JoongAng Daily on-line subscription order system (hereafter “mall”) operated by Joonnsupported by the Joongang Ilbo.

제2조(정의) - Article2.(definition)

①"몰"이란 중앙일보사가 재화 또는 용역을 이용자에게 제공하기 위하여 컴퓨터 등 정보통신설비를 이용하여 재화 또는 용역을 거래할 수 있도록 설정한 가상의 영업장을 말하며, 아울러 사이버몰을 운영하는 사업자의 의미로도 사용됩니다. 
A "mall" refers to the cyber market that presents goods and services to users by information technology facilities, such as computer. It also means the business entity which operates the cyber mall.

② "이용자"란 "몰"에 접속하여 이 약관에 따라 "몰"이 제공하는 서비스를 받는 개인 또는 법인을 말합니다.
"Users" are individuals or corporations that contact the mall and use its services.

제3조(약관의 명시와 개정) - Article3.(the specification and revision of the provision)

① "몰"은 이 약관의 내용과 상호, 영업소 소재지, 대표자의 성명, 사업자등록번호, 연락처(전화, 팩스, 전자우편 주소 등) 등을 이용자가 알 수 있도록 초기 서비스 화면에 게시합니다. 
The "mall" notifies the contents of the provision, the name of the representative 
and the address at the first page of the Homepage.
	
② "몰"은 필요할 경우 약관의 규제 등에 관한 법률, 전자거래기본법, 전자서명법, 소비자보호법 등 관련법을 위배하지 않는 범위에서 약관을 개정할 수 있으며, 약관을 개정할 경우에는 적용일자 및 개정사유를 명시하여 현행약관과 함께 몰의 초기화면에 게재합니다. 
The "mall" can revise the provision as long as it does not violate the laws concerned, if necessary. However, when provisions are changed, it will inform users of the reason and the date along with the present provision at the first page of the website.

제4조(서비스의 제공 및 변경) - Article4.(providing and changing services)

② 입점한 형태로 별개의 운영을 하고 있는 쇼핑몰에서의 서비스는 "몰"과는 별개이며, 해당 서비스에 대한 책임은 이를 제공하는 쇼핑몰에 있습니다. 
Since the operation of other shopping malls is separate from the "mall", these cyber malls are obliged to the result of their services.

제5조(서비스의 중단) - Article5.(the discontinuance of services)

③ "몰"은 제1항의 사유로 서비스의 제공이 일시적으로 중단됨으로 인하여 이용자 또는 제3자가 입은 손해에 대하여 배상하지 않습니다. 
Then, the "mall" does not compensate the users or third parties for the loss, if it does not bear any serious mistake.

제6조(이용자에 대한 통지) - Article6.(Notice for users)

① "몰"이 이용자에 대한 통지를 하는 경우, 이용자가 "몰"에 제출한 전자우편 주소로 할 수 있습니다. 
When the "mall" is to give notices to users, it can use the E-mail addresses presented by the users. 
② "몰"은 불특정다수 이용자에 대한 통지의 경우 "몰" 게시판 및 공지사항에 게시하여 개별 통지를 대신할 수 있습니다. 
If the notice is for an unspecified number of the general public, the bulletin board can take the place of individual notification.

제7조(온라인 구독신청) - Article7.(The registration for subscription)

"몰"이용자는 "몰"상에서 이하의 방법을 사용하여 온라인 구독신청을 합니다. 
Users order a subscription by providing
1. 성명, 주소, 구독기간, 전화번호 입력 
their names, addresses, subscription periods and phone numbers. 
2. 신문을 배달할 장소 
information of delivery address 
3. 결제방법의 선택 
payment type

제8조(계약의 성립) - Article8.(the conclusion of a contract)

① "몰"은 제9조와 같은 온라인 구독신청에 대하여 다음 각호에 해당하지 않는 한 승낙합니다. 
The "mall" accepts the requests for subscription order if 
1. 신청 내용에 허위, 기재누락, 오기가 있는 경우 
there are no errors in its application forms.
2. 온라인 구독신청에 승낙하는 것이 "몰" 기술상 현저히 지장이 있다고 판단하는 경우(배달장소 등)
there’s no fatal problem in technological aspects(such as in delivery).
② "몰"과 이용자간의 온라인 구독계약이 성립한 시점은 이용자가 구독료를 몰에게 전달한 시점으로 봅니다.
The contract comes true when the users pay the bill to the "mall".

제9조(지급방법) - Article9.(Ways to pay)

"몰"에서 구매한 재화 또는 용역에 대한 결제는 다음 중 하나로 할 수 있습니다. 
Users can pay 
1. "몰"이 승인하는 신용카드에 의한 결제 
by credit cards approved by the "mall." 
2. 계좌자동이체
Electronic transfer

제10조(수신확인통지·구매신청 변경 및 취소) - Article 10. (Notification of payment, revision and cancellation)

① "몰"은 이용자의 온라인 구독신청이 있는 경우 이용자에게 별도의 수신확인통지를 하지 않을 수 있습니다. 
The "mall" may not notify users the acceptance of online registration for subscription. 
② 온라인 구독신청을 한 이용자는 배달개시일의 3일전 오전 12시까지 구독계약의 변경 및 취소를 요청할 수 있습니다.
Users who registered subscription should keep in mind that the revision and cancellation of any subscription are possible by 12:00 pm of the third day before the first delivery date.
③ "몰"은 배달개시일 3일전 오전 12시까지 이용자의 구독계약 변경 및 취소 요청이 있는 때에는 지체없이 그 요청에 따라 처리합니다.
The "mall" don’t hesitate to follow the requests to change or cancel any subscription if users keep the time limitation.

제11조(신문배달) - Article 11. (Delivery of Newspaper)

이용자가 "몰" 에 신문구독을 신청하면 배달개시일, 신청부수에 의한 배달을 원칙으로 합니다. 
단, 배달 개시전 천재지변 등 불가항력적인 사유 발생시 이용자의 신청내용과 다르게 배달될 수 있습니다.
We make it a rule that we handle subscription by the requested delivery date and number of copies by users.
Also, there can be some modifications in case of inevitable accidents like natural disasters.

제12조(환급,구독 재신청) - Article 12. (refundment, subscription renewal)

"몰"은 이용자가 신청접수누락 등의 사유로 이용자의 신청대로 신문을 배달할 수 없을 때에는 배달개시일로부터 10일내에 구독료를 반환하거나, 이용자와 "몰"과의 합의가 있을 때에는 이용자가 구독료를 반환받지 않고 신문구독을 다시 신청할 수 있습니다.
The "mall" refunds the bill when the requests from the users are not registered. If there’s an agreement between users and the "mall", users can request a subscription again.

제13조(개인정보보호) - Article 13. (Protection of private information)

① "몰"은 이용자의 정보수집시 서비스 이행에 필요한 최소한의 정보를 수집합니다. 다음 사항을 필수사항으로 하며 그 외 사항은 선택사항으로 합니다. 
The "mall" collects the least information needed for subscription. These are indispensable, while others are optional.
1. 성명(name)
2. 배달장소 (delivery address)
3. 전화번호 (telephone number)
4. 구독기간 (subscription period)
5. 구독부수 (number of copies)
6. 대금결제 (payment)
7. 배달희망일 (delivery start date)

② "몰"이 이용자의 개인식별이 가능한 개인정보를 수집하는 때에는 반드시 당해 이용자의 동의를 받습니다. 
When the "mall" is to collect private information to verify users, the prior agreement from the users is needed.

③ 제공된 개인정보는 당해 이용자의 동의없이 목적외의 이용이나 제3자에게 제공할 수 없으며, 이에 대한 모든 책임은 "몰"이 집니다. 다만, 다음의 경우에는 예외로 합니다. 
The “mall” can neither use the information on its own nor provide them to others without any agreement from the users. All the related responsibilities are on the “mall.” These, however, are exceptions
1. 통계작성, 학술연구 또는 시장조사를 위하여 필요한 경우로서 특정 개인을 식별할 수 없는 형태로 제공하는 경우 
when it is used by collective manner, not able to verify any individual, to make up the statistical report, academic study and market research.

④ "몰"이 제2항과 제3항에 의해 이용자의 동의를 받아야 하는 경우에는 개인정보관리 책임자의 신원 (소속, 성명 및 전화번호 기타 연락처), 정보의 수집목적 및 이용목적, 제3자에 대한 정보제공 관련사항(제공받는자, 제공목적 및 제공할 정보의 내용)등 정보통신망이용촉진등에관한법률 제16조제3항이 규정한 사항을 미리 명시하거나 고지해야 하며 이용자는 언제든지 이 동의를 철회할 수 있습니다. 
When the "mall" needs the agreement of users according to ②, ③, it should previously inform users who manages their information, including his/her position, name and phone number, the purpose of collecting information, who receives the information for what reasons. This comes under Sub-Section 3, Section 16 of Law on the Promotion of Communication Network and users also are guaranteed to refuse the agreement at any time.

⑤ 이용자는 언제든지 "몰"이 가지고 있는 자신의 개인정보에 대해 열람 및 오류정정을 요구할 수 있으며 "몰"은 이에 대해 지체없이 필요한 조치를 취할 의무를 집니다. 이용자가 오류의 정정을 요구한 경우에는 "몰"은 그 오류를 정정할 때까지 당해 개인정보를 이용하지 않습니다. 
Users are able to require to read and correct any wrong information on them at any time and the "mall" is obliged to take proper measures for it immediately. If the users asked the "mall" to correct any mistake, it is not supposed to use the information until it settles the error.

⑥ "몰"은 개인정보 보호를 위하여 관리자를 한정하여 그 수를 최소화하며 신용카드, 은행계좌 등을 포함한 이용자의 개인정보의 분실, 도난, 유출, 변조 등으로 인한 이용자의 손해에 대하여 모든 책임을 집니다. 
To protect the information, the "mall" should limit the number of managers. Furthermore, it is responsible for any loss on users if it is from the robbery, efflux and forgery of individual information including credit card, bank account numbers of the "mall."

⑦ "몰" 또는 그로부터 개인정보를 제공받은 제3자는 개인정보의 수집목적 또는 제공받은 목적을 달성한 때에는 당해 개인정보를 지체없이 파기합니다. 
The "mall" and related partners should not hesitate to destruct the information when they accomplished their purpose.

제14조("몰"의 의무) - Article 14. (the obligation of the mall)

① "몰은 법령과 이 약관이 금지하거나 공서양속에 반하는 행위를 하지 않으며 이 약관이 정하는 바에 따라 지속적이고, 안정적으로 신문배달 서비스을 제공하는 데 최선을 다하여야 합니다. 
The mall should do its best to provide continuous, stable services and keep the provisions.

② "몰"은 이용자가 안전하게 인터넷 서비스를 이용할 수 있도록 이용자의 개인정보(신용정보 포함)보호를 위한 보안 시스템을 갖추어야 합니다. 
The "mall" should be equipped with security system to protect personal information so that users can make good use of its Internet services. .

제15조(이용자의 의무) - Article 15. (the obligation of the users)

이용자는 다음 행위를 하여서는 안됩니다. 
Users are not supposed to

1. 신청 또는 변경시 허위내용의 등록 
provide false information in case of registration or modification.
2. "몰"에 게시된 정보의 변경 
change the information of the "mall". 
3. "몰"이 정한 정보 이외의 정보(컴퓨터 프로그램 등)의 송신 또는 게시 
put up information which is not specified by the "mall".
4. "몰" 기타 제3자의 저작권 등 지적재산권에 대한 침해
infringe on the copyright of the "mall" as well as third parties.
5. "몰" 기타 제3자의 명예를 손상시키거나 업무를 방해하는 행위 
bring disgrace on the "mall" and other and interrupt its operation.
6. 외설 또는 폭력적인 메시지·화상·음성 기타 공서양속에 반하는 정보를 몰에 공개 또는 게시하는 행위 
posting illegal information on the bulletin board.

제16조(연결 "몰"과 피연결 "몰"간의 관계) - Article 16. (The relation between the subject “mall” and patient “mall”)

① 상위 "몰"과 하위 "몰"이 하이퍼 링크(예: 하이퍼 링크의 대상에는 문자, 그림 및 동화상 등이 포함됨)방식 등으로 연결된 경우, 전자를 연결 "몰"(웹 사이트)이라고 하고 후자를 피연결 "몰"(웹사이트)이라고 합니다. 
If the upper "mall" and subordinate "mall" is hyper linked by characters and pictures on the web, the former is a subject "mall"(web site) and the latter is a patient "mall"(web site).

② 연결 "몰"은 피연결 "몰"이 독자적으로 제공하는 재화·용역에 의하여 이용자와 행하는 거래에 대해서 보증책임을 지지 않는다는 뜻을 연결 "몰"의 사이트에서 명시한 경우에는 그 거래에 대한 보증책임을 지지 않습니다. 
The subject "mall" is free from the obligation to guarantee the independent goods and services if it notified in its site.

② 이용자는 "몰"을 이용함으로써 얻은 정보를 "몰"의 사전 승낙없이 복제, 송신, 출판, 배포, 방송 기타 방법에 의하여 영리목적으로 이용하거나 제3자에게 이용하게 하여서는 안됩니다. 
Users are not approved to copy, publicize and distribute the information from the “mall" on a commercial basis and let third parties use them without any prior permission of the “mall".

제18조(분쟁해결) - Article 18. (Settlement of Conflicts)

① "몰"은 이용자가 제기하는 정당한 의견이나 불만을 반영하고 그 피해를 보상처리하기 위하여 피해보상처리기구를 설치·운영합니다. 
The "mall" operates a Compensation Committee to reflect the reasonable opinions and complaints from the users, compensating them.

② "몰"은 이용자로부터 제출되는 불만사항 및 의견은 우선적으로 그 사항을 처리합니다. 다만, 신속한 처리가 곤란한 경우에는 이용자에게 그 사유와 처리일정을 즉시 통보해 드립니다. 
The "mall" puts the complaints from the users in the first place. Otherwise, we inform users the reason and dealing process when it’s hard to settle the problem right away.

③ "몰"과 이용자간에 발생한 분쟁은 전자거래기본법 제28조 및 동 시행령 제15조에 의하여 설치된 전자거래분쟁조정위원회의 조정에 따를 수 있습니다. 
The conflict between the "mall" and users can be settled by the Mediation Committee of the government.

제19조(재판권 및 준거법) - Article 19 (the jurisdiction and standard laws)

① "몰"과 이용자간에 발생한 전자거래 분쟁에 관한 소송은 민사소송법상의 관할법원에 제기합니다. 
The cyber conflicts between the "mall" and users are dealt by the Court concerned according to the Civil Proceedings Act.

② "몰"과 이용자간에 제기된 전자거래 소송에는 한국법을 적용합니다.
Korean laws are adjusted to these cyber conflicts.
